Unfair Dismissal Claims

Under the Industrial Relations Act 1967, an employee who has been dismissed without just cause or excuse may file a representation to the Director General of Industrial Relations for reinstatement. If conciliation is unsuccessful, the Minister may refer the matter to the Industrial Court, which has the power to order reinstatement with back wages or, alternatively, compensation in lieu of reinstatement. The Industrial Court applies the principle established in the Federal Court decision of Milton de Silva v. Union Bank of Colombo, weighing whether the employer acted reasonably in all the circumstances.

Constructive Dismissal

Constructive dismissal occurs when an employer's conduct amounts to a fundamental breach of the employment contract, forcing the employee to resign. Common examples include unilateral changes to job scope, salary reductions, hostile working conditions or failure to pay agreed remuneration. Proving constructive dismissal requires demonstrating that the employer's breach was sufficiently serious and that the employee resigned in response to that breach within a reasonable time. Retrenchment and Redundancy

Employers must follow the "last in, first out" principle unless there are justifiable reasons for departing from it, and must pay retrenchment benefits based on the employee's length of service.
