The Land Acquisition Process
The land acquisition process under the Land Acquisition Act 1960 involves several distinct stages. First, a gazette notification is published declaring the land is required for a public purpose. The Land Administrator then serves a formal notice on the landowner and enters the land to conduct a survey and prepare a plan. An inquiry is held by the Land Administrator, at which the landowner may appear and make representations regarding the compensation payable. After the inquiry, the Land Administrator makes an award specifying the amount of compensation.
If the landowner is dissatisfied with the award, they may apply to the High Court for a reference within a prescribed timeframe. The High Court will reconsider the compensation, taking into account evidence from both the landowner's and the government's valuers. Compensation Assessment
