Writing a Will in Malaysia
A will is a legal document that sets out how you wish your assets to be distributed after your death. In Malaysia, a valid will must comply with the requirements of the Wills Act 1959: it must be in writing, signed by the testator in the presence of at least two witnesses who must also sign in the testator's presence. The witnesses and their spouses cannot be beneficiaries under the will. For Muslims in Malaysia, wills are governed by Islamic law principles rather than the Wills Act 1959. Grant of Probate and Letters of Administration

Where there is no will, or no executor is named or willing to act, an interested party — typically a spouse, child or parent — must apply for Letters of Administration.
The probate process involves preparing and filing the petition, supporting affidavits and the original will, attending court hearings and complying with the Probate and Administration Act 1959. For estates with assets exceeding a certain threshold, sureties may be required unless the court grants an exemption. Administration of Estates
Once a Grant of Probate or Letters of Administration is obtained, the personal representative must gather the deceased's assets, pay outstanding debts and liabilities, file any necessary tax returns, and distribute the remaining estate to the beneficiaries. This process can be complex, particularly where the estate includes real property in multiple locations, business interests, bank accounts, investments or assets located overseas.
