When these marriages break down, the divorce raises complex questions about which country's courts have jurisdiction, which law applies, and how orders made in one country can be enforced in the other.

Which Court Has Jurisdiction?

The question of jurisdiction depends on several factors, including where the marriage was registered, where the parties are domiciled, and where they currently reside. A Malaysian court can hear a divorce petition if at least one party is domiciled in Malaysia. Similarly, Singapore courts can grant a divorce if the parties meet Singapore's jurisdictional requirements.

In some cases, both courts may have jurisdiction. This can lead to competing proceedings, where one party files in Malaysia and the other in Singapore. The court that first seises jurisdiction typically proceeds with the case, though the analysis is more nuanced in practice.

Practical Considerations

For many couples, filing in Johor Bahru makes practical sense. Legal fees in Malaysia are generally lower than in Singapore. The proximity of JB courts to the Causeway means Singapore-based spouses can attend hearings without undue difficulty. And for couples who were married in Johor or own property in JB, the Malaysian courts are well-positioned to deal with property division and related matters.

However, each case is different. Some couples benefit from filing in Singapore, particularly if both parties work there and the matrimonial assets are primarily in Singapore. The right approach depends on the specific facts of each situation.

Enforcement of Foreign Divorce Orders

A divorce order granted in Singapore is not automatically enforceable in Malaysia, and vice versa. The Reciprocal Enforcement of Commonwealth Judgments Act 1952 and related legislation provide a framework for registering and enforcing certain foreign judgments in Malaysia.

For property division, if the matrimonial home is in Johor Bahru but the divorce was granted in Singapore, additional proceedings may be needed in the Malaysian court to give effect to the Singapore order. This is an area where experienced legal advice is essential.
