The Domestic Violence Act provides for two main types of orders. An Interim Protection Order (IPO) can be obtained quickly (often on the same day) when there is an immediate threat. The IPO provides temporary protection while a full application is being prepared.

A Protection Order (PO) is a more permanent court order that can include various conditions: restraining the abuser from committing further violence, requiring the abuser to leave the shared home (exclusive occupation order), and granting temporary custody of children to the victim.

How to Apply for a Protection Order

Victims can file a complaint at the nearest police station. The police are required to investigate the complaint and can assist in the application process. Alternatively, a victim can engage a lawyer to file the application directly at the Sessions Court or Magistrate's Court.

Social welfare officers at the Jabatan Kebajikan Masyarakat (JKM) also play a role in the process, providing support and assisting with documentation. In Johor Bahru, victims can seek assistance from the JKM office or from organisations such as WAO (Women's Aid Organisation).

What a Protection Order Can Include

  • Restraining the abuser from using violence against the victim
  • Requiring the abuser to vacate the shared residence
  • Granting the victim exclusive occupation of the home
  • Prohibiting the abuser from contacting or approaching the victim
  • Temporary custody and maintenance of children
  • Compensation for medical expenses and property damage

Breach of a Protection Order

Breaching a protection order is a criminal offence under the Domestic Violence Act. The perpetrator can be arrested and charged. Penalties include fines and imprisonment. If the abuser breaches the order, the victim should contact the police immediately.
